MINUTES OF TOWN BOARD MEETING (0332)
MARCH 1, 2004
1. Call To Order
The March 2004 Monthly Town Board Meeting was called to order at 7:03 P.M. on Monday March 1, 2004 by Chairman Ullmer. Present were Chairman William Ullmer, Supervisors Cyril Van Laanen, Kenneth Jacobs, Colleen Harris, Jason Horkman, Deputy Clerk Debra
VandenLangenberg, Treasurer Richard DeBauche and Constable Lee Baenen. Excused: Clerk Don Gibson.
2. Affidavit of Posting
The Affidavit of Posting was not presented. Will show Affidavit of Posting at the next Town Board Meeting.
3. Review/Take Action on Minutes
Minutes of the February Meeting were read by the Board. Motion by Horkman, second by Jacobs to approve the minutes as read. Plan Commission agenda was reviewed. Minutes of Zoning Board of Appeals were reviewed and filed.
4. Public Input
Motion by Ullmer, second by Horkman to suspend meeting for public input. All in favor, motion carried. Vote: Yes-5, No-0.
- Mike VanLanen - Bay Settlement Road pedestrian safety, if someone would get injured the Town would have the total cost. Water is standing in front of Deprey’s, Bayland Builders and Victorias, if the Town would have curb and gutter you would not have that water. The Town requires curb and gutter for sub-divisions. Where the city has curb and gutter it is a safety improvement. It would look comparable with the city. VanLanen had a letter from Curt Boulanger, Town of Scott Resident and one of the new owners of the BP Gas Station that he was in favor of the Bay Settlement Road Grant. Ullmer asked VanLanen does UWGB have any concerns for the storm water. VanLanen did not think they did.
- Jim Immel, President of the Brown County Historical Society was present for the Gazebo at the look out point. Marion Sickel gave the land to the Historical Society. Jean Nicolet landed there and there is a monument there. Will present maps at Item #6.
- Jim Sickel is also here to speak on behalf of Marion Sickel for the Historical Site.
- Brad Ottum had a letter to the Town Board dated March 1, 2004. Brad appreciates the Sickel Family donating the land to the Historical Society. He is concerned about the security and maintenance of the site. He is a 25 year tax payer in the Town. He wants these issues addressed and put in writing. Ottum also wanted to get procedures to get alleys in the Town.
Asked Larry DeGroot with the BCHS if they would maintain the site. Security forces - Brown County Sherif Department is responsible for security. Ottum - how far in the future will they be here. Ottum is concerned that they are on the track to be a park. He wants to know and clarified the regulation for the look out site.
- Tina Geronimi - In regards to the dog licenses and about a kennel licenses. At the last meeting there was some inappropriate language that was used and other derogatory remarks. Will not be intimidated by the remarks that were made.
Ullmer was not aware of the language that was said. Geronimi question about the Indian grave sites. Ullmer - there is a burial mound on the new development Hwy K and Nicolet Road at the Wequiock Estates. Geronimi if there is an ordinance for watering lawns with the Bay water? John Lippert, resident of the Town and lives on the bay, said that the DNR lets residents who live on the bay use the water for lawns. If it was to be used for commercial use then they would have to get a permit from the DNR.
- Steve Dallaire - 3679 Sturgeon Bay Road - street light concerns for peoples safety, Bill will look at it at the end of this month.
- Betty DeCleene - In regards to the Jean Nicolet Statue. The State does not want to sell the statue. She would like a road to the statue. She was told that they would have access to their road and they do. They were also told that they would have access to the statue. How does the Town Board feel about the statue? They are concerned and some support this issue.
- Brad Ottum with Reliance Construction - The DOT wanted to close the road. They expect Reliance to remove the parking lot and road. Reliance would need a change order to remove the parking lot.
- Colleen Harris - The DOT has been closing a number of way sides and that was one of them. DNR wants to keep it and put a walking path to the statue.
- Ottum - if the town is interested, they should do something right away.
Put on Agenda for April, 2004.
- Betty Kossik - Bay Settlement Road parking on Bay Settlement Road and Church. They decided not to change it. High Speed Internet - Ullmer - Time Warner was going to get back to Ullmer in a couple of months.
- Bob Schlag is on the Brown County Planning Board and is President of the Village of Bellevue. The County is not overriding the municipalities in Brown County. Smart Growth and letting them control their own housing, streets, transportation, etc.
- Mike Saharsky - He is running for County Supervisor for District #13 and he is one of the Supervisor’s for the Town of Green Bay. Town Government is the best there is and would like to answer any questions or concerns that the people have in this area.
Motion by Jacobs, second by Horkman to return to agenda. All in favor, motion carried. Yes (5) No (0).
5. Take Action on Certified Survey Maps.
Ron Conard - VanLanen Road.
Motion by Jacobs to approve CSM for Conard. Second by Horkman. All in favor, motion passed. Yes (5) No (0).
B. Paul Kosmoski - Bay Heights Seventh Addition.
Motion by Jacobs to table until future meeting. Second by VanLaanen. All in favor, motion carried. Yes (5) No (0).
C. Ivan Gandrud - Gibson Lane.
Grant Soletski with Soletski Survey was present for Ivan Gandrud.
Soletski explained the CSM to the Town Board. VanLaanen would like to know why this isn’t squared off. Soletski said that it is what they wanted and it is legal with all the ordinances. No further discussion.
Motion by Horkman to approve the CSM as presented for Ivan Gandrud. Second by Ullmer. All in favor, motion carried. Aye (5) No (0).
6. Review proposal to construct Gazebo at Red Banks Historical Society Property.
- Jim Immel - The plot of land was donated to the Historical Society by Marion Sickel. Immel presented a map of the property with the parking and gazebo. 16 ft. from NW corner, 26 ft. from the N property line and 13 ft. from the cliff. The gazebo will be on a concrete pad. Inside the gazebo will be the monument and a plaque saying that this land was donated to the BCHS by Marion Sickel. It is one of the only properties that is open for the public to look out. BCHS hopes that people will stop and respect the site. The BCHS has been established for a 105 years.
Jim Sickel - His mother, Marion is 90 years old and could not be here tonight. Mr. Jacqmin would be maintaining and cutting the grass for the site. Marion Sickel did not want to create a park, she just wanted a look out point. On her behalf, she hopes the Town Board approves it.
The property is a historical site already and has been since the year 1634, 370 years ago.
- Ullmer - Brad Ottum brought up further issues: Put a waste container at the site, and have a sign indicating hours when open and no picnics.
- Harris - Have BCHS write a contract for the Town so that it is in writing and that the Town has a record who will maintain all of the work that is done.
Motion by Ullmer to table till April, 2004 Town Meeting, when a draft agreement is made between the Town Board and BCHS for maintaining the site, hours, and who is the contact person if there is any problems. Second by Jacobs. All in favor, motion carried. Yes (5) No (0).
7. Take Action on Bay Settlement Road Reconstruction Grant.
- Ullmer is concerned were the storm water would go. Is Robert E. Lee doing the plats for the project?
- Harris has the traffic projection between the interchange and Cty I. 2014 - 6,945 cars per day, 2024 - 9,080 cars per day, 2001 - 2,900 and north of Cty. - 1,200 cars per day.
Harris had pros and cons to address to the Board. Pros: Concern with Highway to Judy Lane, concern with Algoma and Church Roads, concern with new subdivision ordinance, concern to support the Towns for village, church, school, restaurants, etc., and meets the needs for the Town for Village Status. Cons: Cost to the Town, fear of urbanizing, fear of blasting, and right-a-way might be needed.
Motion by Harris to go ahead with the Grant for the Reconstruction of Bay Settlement Road with curb and gutter and 4 ft. bike trail - Option #1. Second by Jacobs. Vote: Yes (2) No (2) Abstain (1). No action.
There was considerable discussion in regards to the Reconstruction of Bay Settlement Road.
Motion by Ullmer to table until the April, 2004 Town Board Meeting. Second by Horkman. Vote: Yes (2) No (3). Motion failed.
There was more discussion in regards to the Reconstruction of Bay Settlement Road.
Motion by Jacobs to go ahead with the Grant for Reconstruction of Bay Settlement Road with curb and gutter and 4 ft. bike trail - Option #1. Second by Harris. All in favor, motion carried. Vote: Jacobs (Yes), Harris (Yes) & VanLaanen (Yes) - (3) votes yes, Ullmer (No) & Horkman (No) - (2) votes no.
8. Review procedures for issuance of Dog License.
Tina Geronimi has (4) dogs and (1) in hospice care. They would like a kennel license. A kennel license is applied for in October before the end of the year. The licenses is $36.00 and you have to come before the Town Board. Change the ordinance for more dogs. Ullmer will come up with a resolution for Dog Licenses.
9. Take Action on Holy Cross Parish request for beer license.
Motion by Ullmer to approve the beer licenses for Holy Cross Parish. Second by Horkman. All in favor, motion carried. Vote: Yes (5) No (0).
10. Review status of street lights at SH57 Intersections.
Discussion with the Town Board in regards to the street lights at SH57 Intersections.
11. Review/Take Action on Ordinance Proposals.
- Amendment for Quarry change from 500 ft. to 1,000 ft.
The Town Board will have to have a public hearing for the resolution.
- Mischief making on Town Hall Property. No action taken.
- Nature of the offense is amendment for penalty and fines. You don’t have to have a hearing.
No action taken.
12. Town Board/Committees Communications:
A. Update of Board of Review Schedule.
B. VanLaanen and Jacobs updated the open burning laws.
C. Wequiock Creek Development DNR Permit - no report.
D. Century Tele Expanded Services - Information was distributed to the Town Board.
E. Voter Registration - no report.
F. Web Site Status - Office will work on the bugs for the web site and they want the Town
Board Minutes printed back in the Green Bay Press Gazette.
G. Other: Harris will draft up a proposal for the Bay Settlement Road Work and have the Town Board look at the draft for their input on the draft.
13. Schedule Next Meetings.
April 5, 2004 next Town Board Meeting and April 6, 2004 General Election.
14. Treasurers Report
Treasurer DeBauche provided a summary of available funds of $246,951.40. This balance matched the balance reported by the Clerk. Receipts of $1,212,650.98 and disbursement of $1,203,243.45 were reported as of February 2, 2004. Motion by Horkman to approve Treasurers Report. Second by Ullmer. All in favor, motion carried. Yes (5) No (0).
15. Adjournment
Motion to adjourn by VanLaanen, second by Jacobs. All in favor, motion carried. Adjourned at 9:45 P.M.
