MINUTES OF SPECIAL TOWN BOARD MEETING (0427)

DECEMBER 30, 2004

 

1. Call To Order

A Special Town Board Meeting was called to order at 6:00 P.M. on December 30, 2004 in the Town Hall by Chairman Ullmer. Present were Chairman William Ullmer, Supervisors Cyril Van Laanen, Ken Jacobs, Clerk Don Gibson, Treasurer Richard DeBauche, Zoning Administrator Dave Cerny and approximately 20 interested people. Supervisor Mike Van Lanen and Jason Horkman arrive at 6:45 P.M. The Notice of Hearing for Louis DeGroot request for Sewer Service Area stated a start time of 6:00 P.M. The agenda did not state a start time.

2. Public Hearing--Request of Louis DeGroot for Sewer Service Area for Parcel Sc-8

3800 Block of Fischer Road.

Ullmer read the Notice of Hearing. He explained that the process of the hearing would be to hear comments of those in favor of the request and then those opposed to the request with questions for clarification.

In Favor:

Jim Vandertie--Leanna Lane asked why Louis DeGroot was assessed as much as he was when the property was not in the Sewer Service Area. All of Parcel Sc-8 should be in sewer service area or none should be in sewer service area and the assessment should not apply. The property owners on the north side of Fischer Road received no benefit and should not have to pay assessment.

Dale Gerlikovski--Bay Settlement Road Including this parcel in the Sewer Service Area would be better for the DeGroot property and the town. If DeGroot sells the property, it will have added value if in sewer service area. Meachum Realty is interested in purchasing the property. He has personal experience that they are a good company to develop property.

Mel Deprey--Scott Sanitary District #1--Scott Sanitary District #1 recommends that parcel Sc-8 be included in the Sewer Service Area. If it is not in sewer service area, DeGroot can still develop the land as larger agricultural lots that don't have to conform to the Subdivision Ordinance. Storm water runoff, curb and gutter, roads, sewer and water are major concerns.

Lee Novak--R.E.Lee Engineer--Presented a site plan that showed this area as being in orderly growth. Sewer and water is available on Fischer Road. This is adjacent to developed area. Town of Scott has Sewer Service Area available.

Pat Kaster--Kaster Realty--Are interested in the property and would like to develop it. The sewer service area assigned to this property would be returned to the Town for future use as development occurs. Kaster Realty has worked in the Town of Scott in the past developing Royal Scot area.

LaVone Pyan--This would be a good development and benefit the overall area.

June DeGroot--Leanna Lane--They would like to see this area included. It would benefit them financially.

Opposed:

Mark Pennings-- Fischer Road--Not opposed. Will he be charged any assessments because of this? This area terminates to the west of his property. Assessments should not be applied unless sewer and water is available to the property.

Paul Besson--Nicolet Drive--Concerned about the runoff of the storm water in this area that affects properties on Nicolet Drive. Not opposed to development. Sewer, water and storm sewer are beneficial.

David and Judy Pfister--Nicolet Drive (letter)--Concerned about the existing storm water runoff problem affecting homes on Nicolet Drive. A flooding problem exists that needs a solution.

Adjournment: Motion by Ullmer, second by Jacobs to adjourn the hearing. Carried.

3. Review/Take Action on Louis DeGroot Request for Sewer Service Area for Sc-8.

Ullmer reviewed Town of Scott Plan Commission minutes of previous meetings. Town of Scott Plan Commission recommended deferring Special Assessments and not allocating Sewer Service Area to the DeGroot property.

Letter from Joel Dietl of Brown County Planning was reviewed. Brown County policy is to amend the overall Sewer Service Area when a sewer line is installed to include 250 feet on either side of the installed services.

Ullmer stated that the Town of Scott Town Board had not applied for the sewer service expansion for the DeGroot property.

Town of Scott has 150 acres of sewer service area as a reserve. 25 acres would be used on the DeGroot property. It would be returned as a credit when built on.

Motion by Ullmer to deny the request by Louis DeGroot for parcel SC-8 and to take action to remove sewer service area from the 250 feet on the north side of Fischer Road and defer the Special Assessments. No second. Motion failed.

Motion by Jacobs to approve the request of Louis DeGroot to include parcel Sc-8(25 acres) into the sewer service area. Vote: Aye-2, No-1. Carried. Discussion followed on the potential to extend sewer and water to the east as far as Wequiock School and storm water management improvements required.

4. Review/Take Action of Requests for Renewal of Nonmetallic Mining and Blasting Permits.

Applications have been received from the following for renewal of their permits:

Daanen and Janssen--Nonmetallic Mining

Northeast Asphalt--Nonmetallic Mining--Tordeur Quarry

Ed Gersek Inc.-- Nonmetallic Mining

Northeast Asphalt Inc.--Blasting

Viking Explosives--Blasting

Orica--Blasting

All fees have been paid. Performance during 2004 was reviewed. No written complaints were received. Some verbal complaints were received. Followed up with seismograph monitoring. Verbal complaints received from Holland Road residents concerning water quality when blasting occurs. Jerry Charlier has been monitoring blasts with the Town seismograph. No problems have been identified. Discussion followed on the relationship with Vibra-tech, the Town of Scott and the Operators of the quarries. All Nonmetallic Mining sites have submitted reclamation plans to Brown County. No changes were made to boundaries.

Motion by Jacobs, Second by Ullmer to approve the requests for renewal of all nonmetallic mining and blasting permits with boundaries and conditions same as 2004. Vote: Aye-3, No-0. Carried.

5. Appointment of Election Inspectors for 2005/2006.

A listing of candidates to serve as Election Inspectors was presented by the Clerk as follows.

Motion by Ullmer, second by C. Van Laanen to appoint the above listed candidates to a 2 year term(2005/2006) as Election Inspectors for the Town of Scott. Vote Aye 4, No-0. (M Van Lanen arrive)

6. Treasurer/Clerk Report.

Treasurer DeBauche presented a Balance Sheet as of 12/14/04 which indicated a balance on hand of $74,456.82. Outstanding indebtedness of $179,682.91. A listing of receipts of $8,770.89 and vouchers totaling $36,538.59 was presented by the Clerk. Treasurer reported that the Clerk and Treasurer balances matched. Treasurer reported that the printer on his computer failed and he needs to replace it.

7. Next Meeting/Adjournment.

Next meeting will be an information meeting concerning Wayne Boucher request to vacate Hickory Nut Road and a closed session concerning purchase of the Romuald property. The next regular meeting will be January 13, 2005 at 7:00 P.M. Motion to adjourn by Jacobs, second by Ullmer. Carried.
